Terms and conditions

§ 1 General

Subsequent terms and conditions apply to the entire business relationship of ORIGINAL PRODUCT with its customers and by placing an order as binding. They apply exclusively. Conflicting or deviating Terms of our customers are not valid.

§ 2 Contract

a) customer within the meaning of the Conditions must be fully competent.
b) When ordering goods from the product range of ORIGINAL PRODUCT it always is a binding offer by the customer. ORIGINAL PRODUCT may accept this offer by the fact that the ordered goods will be sent to the customer.
c) The automatic acknowledgment of receipt of an order can not be seen as a confirmation of the order, because the order has to be checked.
d) ORIGINAL PRODUCT is not obliged to deliver goods that are no longer available in stock, even if this is still listed in the offer lists of ORIGINAL PRODUCT.

§ 3 Prices

All prices include VAT, in Euro (EUR), excluding shipping costs (see Section 4). Invoiced is the price, which is listed at the time of the order on the website of ORIGINAL PRODUCT. Any writing, printing or calculation errors are reserved.

§ 4 Delivery and cost

a) The goods will be handed over by ORIGINAL PRODUCT to a particular carrier for transmission to the purchaser. The shipment to DHL packing stations is not possible.
b) delivery charge for deliveries within Germany:
1-3 articles delivered = 3.00 Euro, with 4 or more items delivered, the delivery is free shipping.
c) delivery charge for deliveries into the rest of the world:
1-2 articles delivered = 7.00 Euro; 3 or more items delivered = 13.00 Euro
d) If the delivery of an order is not possible, ORIGINAL PRODUCT is entitled to charge the cost of the second shipping charge.

§ 5 Payment

It can be made by PayPal, be paid in advance or cash on delivery (COD).
The COD fee (in addition to the delivery charge) is as follows:
Delivery within Germany (only CDs) = 4.40 Euro
Delivery within Germany (vinyl, other or more different formats) = 8.00 Euro
Delivery to the EU (all formats) = 10.00 Euro
Cash on delivery is not available for deliveries to the rest of the world.

§ 6 Withdrawal

The customer may revoke his contract within two weeks without stating reasons by means of a clear statement (eg. as by letter, fax, e-mail). The period starts from the date on which he or a representative of third party, other than the carrier, receives the goods. To safeguard the withdrawal period it is sufficient to send the revocation. The revocation must be sent to:

For the withdrawal a cancellation form which is provided by ORIGINAL PRODUCT can be used.
If the customer cancels the contract, ORIGINAL PRODUCT recovers any payment which he has made, including the costs of supply (with the exception of additional costs, arising from the fact that he opted for a different method of delivery than the standard type of delivery offered by ORIGINAL PRODUCT), without delay and at the latest within fourteen days from the date back to which the notification of withdrawal of this contract is entered into. For this repayment ORIGINAL PRODUCT uses the same form of payment that the customer has used in the original transaction, unless the customer has expressly agreed otherwise; in any case, the customer will not be charged fees for this repayment.
ORIGINAL PRODUCT may withhold the reimbursement until ORIGINAL PRODUCT has received the returned goods back, or until the customer has proven that he has the goods returned, whichever is the earlier.
The customer must immediately and in any event not later than fourteen days from the date on which he informed ORIGINAL PRODUCT of the cancellation of this contract, return the goods to ORIGINAL PRODUCT, c / o BROKEN SILENCE, Stadtdeich 27, 20097 Hamburg, Germany,. The deadline is met if the customer sends the goods before the period of fourteen days. The customer shall bear the direct cost of returning the goods. The customer only has to pay for any diminished value of the goods, when this loss in value is not due to a necessary handling to ascertain the nature, characteristics and functioning of the goods.
The aforementioned right is not valid for sealed audio or video recordings, if the customer opens or damages the sealed package (unseal § 312 BGB).

§ 7 Complaints

Complaints due to obvious defects, wrong deliveries and / or quantity discrepancies must be notified in writing immediately after discovery. The statutory warranty provisions are in force.
A possible return for justified and accepted complaint is free of charge for the customer. Returned goods must be in a salable condition, unless it is just refers the complaint to this state.

§ 8 Retention of title

ORIGINAL PRODUCT reserves for all supplies full ownership until complete fulfillment of all payment obligations by the customer before.

§ 9 Data protection / data storage

a) The customer agrees that ORIGINAL PRODUCT stores all personal information about the customer received in connection with the business relationship, processed and analyzed in terms of the Data Protection Act.
ORIGINAL PRODUCT uses the customer’s personal data only to process orders.
b) The customer agrees that the instructed parcel service notifies the appropriate current address, if a shipment can not be delivered at the address previously known.
c) The customer has a right of access, rectification, blocking and deletion of personal data given.

§ 10 General Provisions

a) Should individual conditions be wholly or partially judicially declared invalid, the validity of the remaining provisions or parts of these provisions will not be affected.
b) The contractual relations between ORIGINAL PRODUCT and its customers subject to German law.

§ 11 Jurisdiction

The jurisdiction is in Hamburg, unless absolutely no other jurisdiction is given.

§ 12 Dispute Resolution Procedure

Online Dispute Resolution: The European Commission provides a platform for online dispute resolution (under Article 14 (1) ODR Regulation) at https://ec.europa.eu/consumers/odr/.
